These terms govern your use of Anello: this website, the assistant itself, and the two ways you reach it: messages, and your household's own email address. Using any of them means you agree to what's below. If you don't agree, don't use them.
1. Who you're dealing with
Anello is a service of Erik Hope, doing business as Mirabelle Studios ("we", "us"). "You" means the person using the service. Reach us at privacy@bax.bot.
2. The service
Anello is a hosted assistant: the assistant itself, the number we message
you from, your household's address at assistant.bax.bot, the signup
forms, and this website. These terms cover all of it.
3. Eligibility
You must be at least 18 years old and able to enter into a binding agreement to sign up for Anello. When you tick the box on the signup form, you are confirming both.
Anello is for the adults running a household, not for the children in it. Plenty of what you ask will be about your kids: what time practice is, something for them to watch. But the person talking to Nellie should be you. Don't give a child access to your Nellie, and don't set one up on a child's behalf.
If you do share access with another adult, they're your responsibility: you're the one who agreed to these terms, and anything done through your household counts as done by you.
The service is not directed at children under 13, and we do not knowingly collect their information; see the Privacy Policy.
Signing up needs an invite. A personal invite is tied to your email address and is meant for you alone. An open invite code, the kind printed on a card, is meant to be passed around, and sharing one is fine.
4. Messaging
A mobile number on the signup form is required to set up your household, but starts nothing: give one and Nellie still won't message you until you text it first. When you message Nellie at that number you consent to receive messages from Anello in reply and about the things you ask it to handle. That form is the only way to sign up; joining the waiting list with your email is not a signup and starts nothing. Consenting to messages is not a condition of signing up, or of anything else.
You must own or be authorized to use the number, and you agree to tell us if it changes hands.
Messages reach you over Apple's iMessage where your device supports it, and as a standard text where it doesn't. How often varies with how you use it: Nellie replies when you message it and speaks up when something you asked it to watch happens. We never charge you for messages, but where one goes as a standard text, message and data rates may apply between you and your carrier.
Reply STOP at any time to end all messages, START to resume, or HELP for support. Neither we nor any carrier can guarantee a message arrives on time, or at all. How we handle your number is covered in the Privacy Policy. In short, we don't share it.
5. Acceptable use
Don't use Nellie to:
- Break the law, or help someone else break it.
- Harass, threaten, defraud, or impersonate anyone.
- Send spam, or use Nellie to contact people who haven't asked to hear from you.
- Generate malware, or attack systems you don't own.
- Scrape, probe or overload the service, or get around its limits.
- Infringe someone's intellectual property or privacy.
- Submit other people's personal information without a lawful basis.
- Share, sell or publish a personal invite. Open codes are made to be passed on; personal ones are not.
- Pick a household name that impersonates someone else, or that you have no right to use.
We may suspend or terminate access for any of the above, without notice, and we may revoke an invite or reclaim a household name that breaks these rules. A household name becomes an address other people can write to, so we treat it the way we'd treat any other handle.
6. What Nellie tells you
Nellie is an AI assistant. It can be wrong, and sometimes it will be confidently wrong. Its output is generated, not verified, and it may be inaccurate, out of date, incomplete, or misleading, including when it cites a source.
Check anything that matters before you rely on it. Nothing Nellie produces is legal, medical, financial, or professional advice. Don't use it as a substitute for a qualified professional, and don't use it where a wrong answer could hurt someone.
Nellie can take actions you ask for: running code, reading pages, sending you messages, keeping notes. You're responsible for what you ask it to do and for the consequences of those actions.
7. Your content
What you send Nellie stays yours. You grant us only the limited license needed to operate the service: to process your messages, generate replies, and store the notes and documents you asked it to keep. We don't use your content to train AI models, and we don't use it to advertise to you.
You're responsible for having the right to send us whatever you send. Output Nellie generates for you is yours to use, subject to these terms and to any rights held by third parties in the underlying material.
8. Availability
The service is provided as-is and may change, break, or go away. We don't promise uptime, and we may modify, suspend, or discontinue any part of it at any time. We'll give notice of a permanent shutdown where we reasonably can, but we're not obligated to.
9. What it costs
Anello is free while we're getting started. It won't stay that way forever: at some point there will be a price, and there may be a free period before it applies to you.
We will never start charging you silently. Before any charge, we'll tell you what it costs and give you a real chance to say no, and saying no means the service stops, not that you get a bill.
10. No warranty
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY OUTPUT WILL BE ACCURATE OR RELIABLE. Some jurisdictions don't allow these exclusions, in which case they apply to you only as far as the law permits.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE, WHETHER IN CONTRACT, TORT, OR ANY OTHER THEORY, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED ONE HUNDRED US DOLLARS ($100) OR THE AMOUNT YOU PAID US IN THE PRECEDING TWELVE MONTHS, WHICHEVER IS GREATER. Some jurisdictions don't allow these limits, in which case they apply to you only as far as the law permits.
12. Indemnification
You agree to indemnify and hold harmless Erik Hope and Mirabelle Studios from any claim, loss, or expense (including reasonable legal fees) arising out of your content, your breach of these terms, or your violation of any law or third-party right. This does not apply to the extent a claim arises from our own breach of these terms or our own negligence.
13. Termination
You can stop using the service at any time. Replying STOP ends messages but leaves your household running. To close it altogether, email privacy@bax.bot and we'll delete your data as the Privacy Policy describes. Ask first and we'll send you a copy of your notes and lists before it goes.
A household name is taken for good. Once a name has been used it is never reassigned, even after the account is closed. It's an address people write to, and handing it to someone else later would deliver their mail to a stranger.
We may suspend or terminate your access at any time, including for breach of these terms. The sections on your content, warranties, limitation of liability, indemnification and governing law survive after that. A numbered range would go stale the moment a section moved.
14. Governing law
These terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in Alameda County, California, and you consent to their jurisdiction, except that either of us may bring a qualifying claim in small claims court instead.
Before filing anything, email us. Most problems are a misunderstanding and take a day to fix; we ask for 30 days to try. If any provision here is found unenforceable, the rest stays in force.
Nothing here limits any right you have under California law that cannot be waived by agreement. Where a provision of these terms conflicts with such a right, that right governs.
You can't transfer your household or these terms to anyone else. We may transfer them if the business changes hands or form, and they'll bind whoever takes over. These terms and the Privacy Policy are the whole agreement between us. To report content you believe infringes your rights, email privacy@bax.bot.
15. Changes to these terms
We may update these terms. If we do, we'll change the date at the top, and for material changes we'll give notice by text or email before they take effect. Continuing to use the service after that means you accept the new terms.
